Bác sĩ nhận tội gian lận bảo hiểm $154 triệu

SANTA ANA (NV) - Một bác sĩ vừa bị kết tội tham gia đường dây gian lận bảo hiểm y tế tới $154 triệu, trong đó có tám người Việt Nam bị tố cáo đồng lõa, thông cáo báo chí của Văn Phòng Biện Lý Cuộc Quận Cam gởi ra hôm Thứ Năm cho biết.

Bác Sĩ Michael Chan, 65 tuổi, cư dân Cerritos, nhận tất cả 40 tội. Ông có thể bị tuyên án tới 28 năm tù giam.

Tám bị cáo Việt Nam, bị tố cáo tội môi giới và làm hồ sơ cho vụ gian lận này, gồm có Thuy Huynh, Ngoc Huynh, Henry Truong, Amanda Phuc Tran, Nicholas Vu, Tam Vu Pham, Huong Thien Ngo và Lan Thi Ngoc Nguyen. Tất cả những bị cáo này đều đứng tuổi, từ 43 tới 55 tuổi.

Hầu hết 8 bị cáo này đều là người nhà, họ hàng thân thuộc hoặc bạn bè của nhau.

Biện Lý Cuộc cho rằng đây là vụ gian lận bảo hiểm y tế lớn nhất Hoa Kỳ, liên quan đến 19 đồng phạm và trung tâm y tế Unity Outpatient Surgery Center ở Buena Park.

Những người này bị cáo buộc chiêu dụ 2,841 người khỏe mạnh khắp nước Mỹ đến Unity giải phẫu không cần thiết để trung tâm này tính tiền các công ty bảo hiểm của họ.

Ðổi lại, những “bệnh nhân” này được “thưởng” một số tiền, từ $300 đến $1,000/lần, hoặc được hưởng giải phẫu thẩm mỹ giá rẻ.

Những cuộc mổ bị Unity tính tiền cho bảo hiểm là soi ruột, giải phẫu tuyến mồ hôi tay, cắt trĩ và các chứng đau nhức khác.

Unity chỉ hoạt động trong 17 tháng từ 2002 đến 2003.

Ngoài những người nêu trên, một số người khác, trong đó có hai bác sĩ, cũng bị tố cáo tội đồng lõa.

Trong các phiên xử trước, hai vợ chồng Tam Vu Pham và Huong Thien Ngo đã nhận tội. Bị cáo Lan Thi Ngoc Nguyen, cô của Huong Thien Ngo, cũng nhận tội.

Bị cáo Tam Vu Pham bị 12 năm tù, trong khi Huong Thien Ngo lãnh án tù treo 7 năm, nếu hoàn thành đầy đủ 5 năm quản chế, và 87 ngày ngồi tù. Bị cáo Lan Thi Ngoc Nguyen cũng thú nhận tội trạng và lãnh án 5 năm tù treo, nếu hoàn thành đầy đủ 5 năm quản chế, và 224 ngày ngồi tù.

Cuộc điều tra kéo dài hai năm do Biện Lý Cuộc Quận Cam thực hiện với sự hỗ trợ của Bộ Bảo Hiểm California.

Vụ án được bắt đầu khởi tố từ năm 2006. Phía công tố còn đang tiếp tục điều tra và khởi tố các nghi can khác. (Ð.D.)

Doctor convicted of insurance fraud in Orange County surgery scam

Dr. Michael Chan of Cerritos faces 28 years in state prison after being convicted of billing health insurers for unnecessary, dangerous surgeries.

A 65-year-old doctor was convicted Thursday of performing unnecessary and dangerous surgeries on more than 160 people in a $154-million medical insurance scam that lured patients by promising them cash or low-cost cosmetic surgeries.

Dr. Michael Chan of Cerritos, one of 19 defendants accused of fraudulently billing medical insurance companies, pleaded guilty in Orange County Superior Court to 40 felony counts, including conspiracy to commit insurance fraud and insurance fraud.

He faces up to 28 years in state prison.

Nearly 3,000 people across the U.S. allegedly agreed to undergo unnecessary procedures such as sweaty palm surgeries and colonoscopies at the Unity Outpatient Surgery Center, a Buena Park facility which is now closed.

Recruiters, known as "cappers," targeted employees from businesses in 39 states who were covered by PPO insurance plans. Prosecutors likened them to "body snatchers."

Patients, who typically received between $300 and $1,000 per surgery, were allegedly coached on how to describe their symptoms by the cappers who then scheduled their surgeries, assisted them with paperwork and arranged their travel. Recruiting patients is illegal in California.

Chan was the owner and medical director of Unity. He specialized in invasive gynecological surgeries and performed laparoscopy, tubal ligation, colporrhaphy and hysterectomy procedures.

Along with Dr. William Hampton Jr., 55, of Seal Beach and Dr. Mario Rosenberg, 63, of Beverly Hills, Chan was accused of ignoring basic medical protocol, such as failing to obtain medical information, not meeting with patients beforehand and neglecting to follow up.

The surgeries were mainly performed on weekends. All three doctors were arrested in 2007.

Nine defendants pleaded guilty and have been sentenced, including Hampton, who was sentenced to 16 years in state prison.

The remaining nine are scheduled to appear Friday for a pretrial hearing at the Central Justice Center in Santa Ana. In addition to doctors and cappers, the defendants include an attorney, an accountant and administrators.

Chan's sentencing date has not been set.

The Unity case was investigated by the California Department of Insurance and the Orange County district attorney's office, with assistance from the California Franchise Tax Board.
